Order JUS/2296/2005, of July 12, 2005, on selection, proposal and appointment of interim civil servants to fill positions of civil servants of the bodies at the service of the Administration of Justice.
Interim civil servants shall be subject to the regime of career civil servants as appropriate to the nature of their condition. They shall have the same rights and duties as career civil servants, except for the fixity in the job position, receiving the same basic and complementary remuneration, except for triennia, and shall be integrated into the general Social Security system.
The purpose of this Order is to establish the objective criteria for the selection of interim civil servants within the scope of competence of the Ministry of Justice, in accordance with the provisions of Article 489.1 of Organic Law 6/1985, of July 1, 1985, of the Judiciary.
On the other hand, the Thirteenth Transitory Provision of Organic Law 19/2003 empowers the competent Administrations so that within eighteen months as from the entry into force of said Law, they proceed to issue the corresponding regulations on interim civil servants, in accordance with the provisions contained therein.

1. The Ministry of Justice or, as the case may be, the competent bodies of the autonomous communities that have received the transfers of personal means for the operation of the Administration of Justice, may appoint interim civil servants, due to the needs of the service, when it is not possible, with the urgency required by the circumstances, the provision by a career civil servant, in accordance with the objective criteria to be established in the ministerial order or, as the case may be, the provision of the autonomous community that has received the transfers of personal means for the operation of the Administration of Justice.
2.    Those appointed shall meet the requirements and qualifications necessary for entry into the Corps; they shall take office within the term established by regulation and shall have the same rights and duties as civil servants, except for the fixity of the position and the same basic and supplementary remuneration.
The three-year increments corresponding to the services rendered shall be recognized, which shall have remunerative effects in accordance with the provisions of the regulations in force for civil servants of the General State Administration. This recognition shall be made upon request of the interested party.
